A Notice of Proposal (NoP) to Cancel Registration is one of the most serious enforcement actions the Care Quality Commission (CQC) can take. Understandably, receiving one can be a worrying experience for any provider or registered manager.

However, it’s important to know that a Notice of Proposal is not the same as having your registration cancelled.

A Notice of Proposal is the CQC’s formal notification that it intends to take action, usually because it believes there are serious concerns about the quality, safety, or leadership of a service. These concerns may relate to safeguarding issues, repeated breaches of regulations, poor governance, or ongoing risks to people using the service.

What Happens After a Notice of Proposal?

In most cases, providers have the opportunity to make representations to the CQC before a final decision is made. This allows them to respond to the concerns raised, provide evidence of improvements, and explain why the proposed action should not proceed.

The CQC will then review this information before deciding whether to withdraw the proposal or move forward with a Notice of Decision.

If a Notice of Decision is issued, providers may have the right to challenge the decision through the tribunal process.
