Case Study: Emergency CQC Enforcement and Interim Management Support

Providers with a long history of positive CQC ratings can still face significant regulatory challenges when concerns emerge around leadership, governance or management oversight.

Recently, HLTH Compliance was contacted by an established adult social care provider that had maintained a Good CQC rating for more than 20 years. Following its most recent inspection, the service was rated Requires Improvement, with concerns subsequently escalating to a Notice of Proposal to withdraw the provider’s registration.

The situation was compounded by an immediate leadership crisis. Following receipt of the Notice of Proposal, the Registered Manager left the organisation without notice, leaving the provider without the management and governance leadership it needed at a critical point in the regulatory process.

The Challenge

The provider contacted HLTH Compliance on a Friday morning, requiring urgent regulatory, governance and operational support.

The organisation faced several challenges simultaneously:

  • A formal Notice of Proposal from CQC requiring a detailed, evidence-based response.
  • The unexpected departure of the Registered Manager without an effective handover.
  • An immediate gap in operational leadership and management oversight.

Despite the service’s longstanding history of Good ratings, the circumstances required immediate action. The provider needed to demonstrate that it understood the concerns raised, had taken them seriously and had the leadership, systems and resources in place to deliver meaningful improvement.

Immediate Mobilisation

Given the seriousness of the situation, HLTH Compliance mobilised immediately.

From the initial contact on Friday morning, our priority was to stabilise the service and provide CQC with assurance that experienced external support had been engaged.

By the following Monday, HLTH Compliance had placed an experienced Interim Manager within the service, restoring day-to-day management oversight and providing an immediate leadership presence for staff, people using the service and external stakeholders.

At the same time, members of the HLTH Compliance Senior Leadership Team became directly involved in overseeing the regulatory response and wider improvement programme.

This enabled the provider to demonstrate from the outset that the concerns were being treated seriously and that appropriate specialist resources had been mobilised at pace.

Responding to the Notice of Proposal

Alongside operational stabilisation, our Governance and Risk Assurance team began supporting the provider with its formal response to CQC.

Working collaboratively with the provider and specialist legal representatives, we undertook a detailed review of the concerns raised within the Notice of Proposal and began building the evidence required to demonstrate both immediate action and sustainable improvement.

The work included:

  • Reviewing each regulatory concern and identifying the evidence required to address it.
  • Supporting the preparation of a detailed and structured formal response to CQC.
  • Working alongside partner solicitors to align the regulatory, operational and legal response.
  • Reviewing existing governance, quality assurance and management systems.
  • Identifying gaps in compliance evidence and management oversight.
  • Collating evidence of improvements already completed.
  • Developing a comprehensive action plan addressing the concerns raised by CQC.
  • Establishing clear ownership, timescales and evidence requirements for improvement actions.
  • Providing senior leadership oversight throughout the response process.

The objective was not simply to challenge the proposed regulatory action. It was to provide CQC with clear evidence that the provider understood the concerns, had acted immediately and had a credible structure in place to deliver sustained improvement.

Stabilising the Service

The departure of the Registered Manager created an immediate operational and regulatory risk.

Our Interim Manager therefore worked directly within the service to restore leadership continuity while the wider regulatory response was being developed.

This included strengthening management oversight, supporting staff, reviewing operational systems and ensuring that priority compliance actions were addressed without delay.

At the same time, our Senior Leadership Team maintained oversight of the wider improvement programme, enabling the operational turnaround and formal regulatory response to progress in parallel.

This combination of on-site management support and senior regulatory oversight was critical.

CQC needed reassurance not only through written representations, but through clear evidence that meaningful changes were already taking place within the service.

From Regulatory Response to Sustainable Improvement

The engagement has since developed into an ongoing programme of operational and compliance improvement.
